Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Plane Identifier ("we," "our," or "us") regarding your use of the Plane Identifier mobile application (the "App").

By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

Plane Identifier is a mobile application that uses artificial intelligence to identify aircraft from photographs. The App provides:

• AI-powered aircraft identification using image recognition technology
• Aircraft information including family, airline, and registration details
• Personal hangar to save identified aircraft
• Gamification features including achievements, XP points, and levels
• Collection tracking and statistics
• Optional premium subscription for unlimited access

Eligibility

You must be at least 13 years old to use this App. By using the App, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into this agreement
• You will use the App in compliance with these Terms and applicable laws
• All information you provide is accurate and current

User Accounts and Registration

Account Creation

The App uses device-based authentication and does not require traditional account registration. Your data is associated with your device and optionally synchronized through Apple's CloudKit service.

Account Security

You are responsible for:

• Maintaining the security of your device
• Protecting your Apple ID credentials if using CloudKit sync
• Notifying us immediately of any unauthorized use

Acceptable Use

Permitted Use

You may use the App for personal, non-commercial purposes to identify aircraft and track your spotting activities.

Prohibited Activities

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Upload inappropriate, offensive, or copyrighted content
• Interfere with or disrupt the App's functionality
• Use the App to violate aviation security regulations
• Attempt to access restricted areas of airports or aircraft
• Share or distribute the App without authorization
• Use automated systems to interact with the App

Content and User Data

Your Content

You retain ownership of photos and data you provide to the App. By using the App, you grant us a limited license to:

• Process your images for aircraft identification purposes
• Store your hangar data and achievements locally and in CloudKit
• Use aggregated, anonymized data for service improvement

Our Content

The App, including its design, features, and aircraft information database, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

Third-Party Content

Aircraft identification results are generated using third-party AI services. While we strive for accuracy, we cannot guarantee the correctness of all identifications.

Subscription and Payment Terms

Free Tier

The App offers limited free access including:

• 20 aircraft identifications per month
• Storage of up to 3 aircraft in your hangar
• Basic achievement tracking

Premium Subscription

Premium subscriptions provide:

• Unlimited aircraft identifications
• Unlimited hangar storage
• Advanced analytics and statistics
• Priority customer support

Payment and Billing

• Subscriptions are processed through the Apple App Store
• Payments are charged to your Apple ID account
• Subscriptions automatically renew unless cancelled
• You can manage subscriptions in your device settings
• No refunds are provided for partial subscription periods

Price Changes

We reserve the right to modify subscription prices. Price changes will apply to new subscriptions and renewals after notice is provided.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data Processing

By using the App, you consent to:

• Processing of your images for aircraft identification
• Storage of your data as described in our Privacy Policy
• Transfer of data to third-party service providers

Disclaimers and Limitations

Service Availability

We strive to maintain App availability but do not guarantee uninterrupted service. The App may be temporarily unavailable for maintenance or technical issues.

Accuracy Disclaimer

Aircraft identification results are generated using AI technology and may not always be accurate. You should not rely solely on our identifications for:

• Aviation safety or security purposes
• Commercial or professional aircraft identification
• Legal or regulatory compliance

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF YOUR USE OF THE APP.

Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Indemnification

You agree to indemnify and hold harmless Plane Identifier and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit through the App

Termination

Termination by You

You may stop using the App at any time by deleting it from your device. Your premium subscription will continue until the end of the current billing period.

Termination by Us

We may terminate or suspend your access to the App at any time for:

• Violation of these Terms
• Suspected fraudulent activity
• Legal or regulatory requirements
• Discontinuation of the service

Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• Local data may be retained on your device
• CloudKit data may be deleted according to Apple's policies
• Premium subscription benefits end

Intellectual Property

Our Rights

The App and all related intellectual property rights are owned by Plane Identifier. This includes:

• App design and user interface
• Aircraft identification algorithms and databases
• Gamification systems and achievement structures
• Trademarks and branding

License to Use

We grant you a limited, non-exclusive, non-transferable license to use the App for personal purposes in accordance with these Terms.

Trademark Notice

"Plane Identifier" and related marks are trademarks of Plane Identifier. You may not use our trademarks without prior written consent.

Updates and Modifications

App Updates
